Local governments that give out cable TV franchises can award one or more franchises in their area. They may not give an exclusive franchise. They must not unreasonably block another company from getting a franchise, and a denied applicant can appeal under section 555. A franchise lets the cable company build its system over public streets and through easements in the service area. While using easements, the company must avoid harming safety, use, or appearance of the property, pay the costs of installing, operating, or removing its equipment (or have subscribers pay), and fairly pay property owners for any damage. The local government must also make sure low-income neighborhoods are not left out, must allow a reasonable time for the system to reach all homes, and may require promises about public/educational/government channels and the operator’s qualifications. A cable company generally must have a franchise to offer cable service, except for those already lawfully providing service on July 1, 1984, unless a local authority requires a franchise. If a cable company or its affiliate offers telecommunications services, those telecom services are not covered by this franchise law and local rules cannot block or limit them, force them to stop telecom services for lacking a franchise, or make them provide telecom services (other than institutional networks) as a condition of getting or renewing a franchise. Cable systems are not treated as common carriers or utilities for providing cable service. States and the FCC can require filing informational tariffs for certain intrastate communications services, and States keep their authority to regulate non-cable communications services. "State" is defined in section 153. Local governments that also act as franchising authorities may operate a multichannel video distributor in the same area and do not need a franchise to do so.
