Title 49 › Subtitle SUBTITLE VI— - MOTOR VEHICLE AND DRIVER PROGRAMS › Part PART B— - COMMERCIAL › Chapter CHAPTER 311— - COMMERCIAL MOTOR VEHICLE SAFETY › Subchapter SUBCHAPTER III— - SAFETY REGULATION › § 31134
Employers and people must register with the Secretary of Transportation and get a USDOT number before they can operate a commercial motor vehicle in interstate commerce. The Secretary can also register someone who does not do interstate work. Employers covered by subchapter I of chapter 135 must apply for registration under section 13902. The Secretary will only register someone if the Secretary finds they are willing and able to follow the safety rules in this subchapter and in chapter 51, and if, during the 3-year period before the application, they are not related to any person who was unfit to follow those rules unless they have told the Secretary about any such relationship. The Secretary must cancel a registration after notice and a chance to be heard, or may suspend it after notice, if the person’s chapter 139 authority is subject to revocation under sections 13905(d)(1) or 13905(f), or they knowingly failed to follow the safety rules, hid a relationship to an unfit person, or refused the safety review under section 31144(g). Employers must update their registration within 30 days after changes in address, contact, officers, process agent, or other essential information. This law does not stop a State from issuing a DOT number for intrastate operators.
