Protects motor carriers, people who give safety records, and their agents or insurance companies from lawsuits about defamation, privacy, or breaking a contract when they share or use driver safety records under the Secretary’s rules. The protection only applies if the carrier or record-provider follows the rules: they must give the driver a fair chance to see and comment on the records, take reasonable steps to keep the records private (except to an insurer who needs them), use the records only to judge the driver’s safety for hiring, and make sure the records are accurate. The protection does not cover anyone who knowingly gives false information. States may not make laws that punish or block sharing or using these records under the Secretary’s rules. Written permission is not required to get a person’s motor vehicle driving record when deciding about hiring them for a motor carrier.
