A State can let the State or a local government fine the person who gives a loaded container or trailer to the first carrier if a tractor‑trailer carrying that load breaks a State highway weight law because the person put wrong information on the certificate that section 5902(b) requires and thus violated section 5903(a). The State can also let officials hold the container or trailer until the fine is paid by the owner, the beneficial owner of the contents, or the person who gave the load to the carrier. Under this chapter, a person who gives a loaded container or trailer to the first carrier is not required to make the first carrier or any other carrier follow State highway weight laws, except for what this chapter already requires.
