If an employee has a medical emergency and applies for donated leave, they must first give some of their own accrued annual leave to their agency’s leave bank in the same leave year. The donation must be made before the employee files the application, and it must go to the same leave bank they use when applying. How much to give depends on years of service: under 3 years = 4 hours, 3 to under 15 years = 6 hours, 15 years or more = 8 hours. The agency’s Leave Bank Board, after talking with the Office of Personnel Management, can lower the minimum if the bank has too much leave or raise the minimum for the next year if there is a shortage. Employees may give more voluntarily, up to the limit in section 6365(b).
