Excepted agencies and their employees may not join leave bank programs set up earlier in this chapter, unless the FBI Director allows an FBI employee to join a Justice Department leave bank when doing so will not harm the protection of intelligence sources and methods. "Excepted agency" — the special type of agency named in section 6339(a)(1). "Head of an excepted agency" — the agency leader named in section 6339(a)(2). The leader of an excepted agency can make a voluntary leave bank by rule. In that program, employees can give annual leave to a pool, and other employees can get leave for medical emergencies. Programs should follow the chapter's rules as much as possible and protect intelligence sources and methods. The Office of Personnel Management must help the agency head if asked.
