Gives employees the right to take time off for family and medical reasons. An employee can take up to 12 weeks off in a 12-month period for things like caring for a new child (birth, adoption, or foster care), caring for a sick spouse, child, or parent, dealing with their own serious health problem, or handling a qualifying military family need. Time for birth or placement must be used within 12 months after the birth or placement. If the employee is caring for a covered servicemember, they can take up to 26 weeks in a single 12-month period, and during that same single 12-month period the most they can take total for all reasons is 26 weeks. Leave is usually unpaid, but employees may choose to use their accrued annual or sick leave instead. For birth or placement, an employee may get up to 12 weeks of paid parental leave from the agency (in addition to any accrued leave they use) if they had at least 12 months of service before the birth or placement. Paid parental leave must be used within the 12-month period, is paid from agency funds, does not count as annual leave, and does not carry over. The employee must agree in writing to return to work for at least 12 weeks after paid parental leave or may have to repay certain government-paid health costs, though the agency must waive repayment if the employee can’t return because of a serious health problem or other uncontrollable reason. Parental leave for birth or placement generally cannot be taken in pieces unless the agency agrees; medical or servicemember-care leave can be taken intermittently when needed, and employees should give 30 days’ notice for planned events or as much notice as is practical.
