When the President declares a major disaster or emergency that harms many workers, the President can tell the Office of Personnel Management to set up an emergency leave transfer program. Under that program, any employee at any Executive agency can give unused annual leave to employees in the same or other agencies who were affected. Employee: defined by section 6331(1). Agency: means an Executive agency. The Office must write rules for the program, limit donations and use, allow recipients to use transferred leave without spending their own first, let leave banks under subchapter IV donate as allowed, and include judicial branch employees after consulting the Administrative Office of the United States Courts. Unless the Office says otherwise, section 7351’s rules do not apply to asking for, giving, or accepting leave under this program.
