People (or their survivors or beneficiaries) cannot be paid an annuity or retired pay for service that counts toward those payments if the person is under indictment or has charges under the Uniform Code of Military Justice for certain offenses (for offenses listed after July 31, 1956, or after September 26, 1961) and then willfully stays outside the United States, its territories and possessions (including Puerto Rico) for more than 1 year while knowing about the indictment or charges, unless two exceptions apply elsewhere. The payment ban begins after that 1-year period and stays in effect until either all charges are formally dropped, the person returns and the charges are dismissed, or a trial or court-martial finds the person not guilty.
