It does not give the Secretary or any other federal official new power to make or enforce rules. Except as stated in sections 186(c) and 441(c) of this title and section 1315 of title 40, it only moves into the Department the rule-making power that already existed on November 25, 2002, for any agency, program, or function moved there. Once a power is moved, the official who lost it cannot keep using it. It does not reduce or change other agencies’ powers except for any parts actually moved. It does not cancel or override state or local laws. The only exception is that any federal power to override state or local law that belonged to an agency or official moved into the Department also moves to the Department on the date that agency or official is moved.
