Certain rural housing loans are excluded from sections 501(c) and 502(b)(3) of the Housing Act of 1949 if three things are true: they are guaranteed by the Secretary under section 517(a)(2) of the Housing Act of 1949, they are made by lenders the Secretary has approved to provide homes in rural areas for the borrowers to live in, and their interest and fees do not exceed the maximum rates HUD sets for similar guaranteed private loans under the National Housing Act. For purposes of Title V or this chapter, a payment guarantee given under the authority of the Department of Hawaiian Home Lands (or its successor) will be treated by the Secretary as reasonably assuring repayment of the debt it guarantees.
