The Authority must, within 90 days after May 13, 2002 and every year after, pick which counties in the region are distressed, which are not distressed, and which small areas inside nondistressed counties are isolated pockets of distress. Distressed counties are the most underdeveloped and have high poverty, unemployment, or people leaving. Nondistressed counties are the rest. Isolated areas of distress are high-poverty or high-unemployment spots inside nondistressed counties. At least 50 percent of the money made available under section 2009bb–12 must go to programs and projects that help distressed counties and those isolated areas. Rules that limit funding under section 2009bb–3(b) do not apply to projects that bring transportation, telecommunications, or basic public services to people in distressed counties or isolated areas. Also, at least 50 percent of any funds under section 2009bb–12 must be used for transportation, telecommunications, renewable energy, and basic public infrastructure projects authorized under the listed parts of section 2009bb–2(a).
