The Secretary must hold a vote of watermelon producers, handlers, and importers who are not exempt and who were active during a time the Secretary chooses. Ballots and any information that could show a person’s vote or how much they produced, handled, or imported must be kept secret. Employees who break that secrecy face legal penalties. A plan only takes effect if a majority of the producers and handlers voting (and any covered importers) approve it.
