Title 7 › Chapter CHAPTER 90— - MUSHROOM PROMOTION, RESEARCH, AND CONSUMER INFORMATION › § 6108

Last updated Apr 6, 2026|Official source

Summary

The Secretary can investigate when needed to run the program or to find out if someone broke the rules or orders under this chapter. For an investigation the Secretary can make people swear to tell the truth and can issue subpoenas to get records from anywhere in the United States. At administrative hearings under sections 6106 or 6107, the presiding officer can also make people swear, call and require witnesses, take evidence, and demand records from anywhere in the United States. If someone refuses a subpoena, the Secretary can go to a federal court where the person lives, does business, or where the case is happening to force compliance. The court can order the person to comply, and failure to obey that order can be treated as contempt. Legal papers can be served in the district where the person lives, works, or is found. Hearings under sections 6106 or 6107 must be held in the judicial district where the person lives or has a main business.
