§6b Contracts designed to defraud or mislead

Title 7 › Chapter CHAPTER 1— - COMMODITY EXCHANGES › § 6b

Last updated Apr 6, 2026|Official source

Summary

Makes it illegal to cheat, lie to, or trick another person in connection with buying or selling commodity futures, swaps, or similar contracts. Anyone trading for someone else or trading with someone else must not give false reports or records, deceive about orders or how they were handled, keep an order instead of sending it to the market when it was supposed to be executed there, or secretly match someone’s buy and sell orders without their OK when the order was meant for a regulated exchange. You do not have to share private market-moving information unless not saying it would make something you told the other person misleading. A broker may match opposite orders for different clients only if both orders are on the exchange floor, done publicly, reported and cleared, and follow commission rules. The rule does not apply to trades on foreign exchanges. It also makes it illegal to use mail, phones, the internet, or exchange facilities to defraud, lie about important facts, or leave out important facts in certain futures, options, or swaps on groups or indexes of securities.

(3)to engage in any act, practice, or course of business which operates or would operate as a fraud or deceit upon any person.
