The Commission must enforce most rules in Subtitle A of the Wall Street Transparency and Accountability Act for everyone, except in certain cases. Prudential regulators alone enforce the specific part in section 6s(e) for swap dealers or major swap participants they supervise. If a prudential regulator thinks one of those dealers or its affiliate may have broken nonprudential rules, it can send a written report to the Commission asking it to start enforcement and explaining why. If the Commission thinks the dealer may have broken prudential rules, it can send a written report to the prudential regulator asking it to act and explaining the concerns. If the recipient does not start an enforcement case within 90 days of getting the report, the sender may start one.
