Title 7 › Chapter CHAPTER 101— - AGRICULTURAL PROMOTION › Subchapter SUBCHAPTER IV— - KIWIFRUIT › § 7463
The Secretary must create a national order that applies to kiwifruit producers, handlers, and importers. Only one such order can be in effect at any time. Anyone who would be affected can ask for an order and submit a proposal. Within 90 days of getting a request and proposal, the Secretary must publish a proposed order and allow public comment. After the comment period, the Secretary must issue the order, consider the comments, and make sure it follows the law. The Secretary can later change the order, and the same rules apply to changes except a referendum is not needed for an amendment to take effect.
