§7486 Petition and review

Title 7 › Chapter CHAPTER 101— - AGRICULTURAL PROMOTION › Subchapter SUBCHAPTER V— - POPCORN › § 7486

Last updated Apr 6, 2026|Official source

Summary

A person who is under an order can ask the Secretary to change the order or excuse them. The person must say the order, a part of it, or an obligation tied to it was not made according to law. Challenges to an obligation must be filed within 2 years after the obligation was imposed. The person gets a hearing under rules set by the Secretary. After the hearing, the Secretary will issue a decision. That decision stands if it follows the law. If the person is unhappy, they can ask a U.S. district court where they live or do business to review the Secretary’s decision. They must file the court case within 20 days after the Secretary’s decision. To start the case, give a copy of the complaint to the Secretary. If the court finds the decision broke the law, it will send the matter back to the Secretary with instructions to make the proper ruling or take more steps the court requires. Filing a petition does not stop the Secretary or the Attorney General from acting under section 7487.
