§7803 Issuance of orders

Title 7 › Chapter CHAPTER 105— - HASS AVOCADO PROMOTION, RESEARCH, AND INFORMATION › § 7803

Last updated Apr 6, 2026|Official source

Summary

The Secretary must create national orders that apply to producers, importers, and first handlers of Hass avocados. Only one such order can be in effect at a time. A state‑chartered avocado producer group, or anyone who would be affected, may ask for an order and submit a proposal. If a state group sends a proposal, the Secretary must publish the proposed order and open it for public comment within 60 days of receiving it. After public comment, the Secretary will issue an order that follows the law and takes comments into account. The order only becomes effective after an affirmative vote in a referendum (see section 7805) and must be issued no later than 180 days after the proposed order was published. The Secretary may later amend an order, and the same rules apply to any amendment.
