The Commission can write or approve official explanations of two rules to say what business practices are acceptable. Those explanations can be the only way a company has to follow those rules. A contract market, a derivatives trading platform, or an electronic trading facility may pass some duties to a registered futures group or another registered entity. Even if duties are passed on, the original market or platform is still responsible. If it learns a duty is not being done right, it must quickly fix the problem. A registered market or clearing group can start trading or clearing a new contract or put a new rule into effect by sending the Commission a written statement saying it follows the law. For government-security futures, they must also tell the Treasury Secretary. The rule or contract usually takes effect 10 business days after the Commission gets the statement unless the Commission pauses the start because the matter is new, complex, unclear, or may clash with the law. That pause can last up to 90 more days. During that pause the Commission must allow at least a 30-day public comment period. A market can ask the Commission to approve a change first. If approval is asked, the Commission must decide within 90 days unless more time is agreed to. The Commission must approve new rules or contracts unless they break the law. The Commission can block contracts it finds against the public interest if they involve unlawful acts, terrorism, assassination, war, gaming, or similar activity. For swaps, the Commission will check whether a clearinghouse is fit to clear them and will consider its financial soundness. Emergency powers of the Commission are not affected. Markets and trading platforms must also make rules so firms that are also registered with the Securities and Exchange Commission do not face duplicate or conflicting rules.
