Title 8 › Chapter CHAPTER 12— - IMMIGRATION AND NATIONALITY › Subchapter SUBCHAPTER I— - GENERAL PROVISIONS › § 1105a
The Secretary of Homeland Security can allow a noncitizen spouse admitted under subparagraph (A), (E)(iii), (G), or (H) of section 1101(a)(15) who is joining a principal noncitizen admitted under the same categories to work in the United States. The spouse must show that during the marriage they or their child were battered or subjected to extreme cruelty. Requests must follow the procedures used under section 1154(a)(1)(A)(iii). Allowing work permission this way only lets the person work. It does not give any other immigration benefits.
