Deadline to Request Administrative Review
If you import goods covered by the listed AD/CVD orders, you must request an administrative review no later than the last day of January 2025. If Commerce does not receive a review request by that date for the listed orders covering 1/1/24–12/31/24, Customs will be instructed to assess duties on those entries at the cash deposit rate that was required at time of entry.
Respondent Selection Uses CBP Import Data
Commerce intends to select respondents for limited individual examination using U.S. Customs and Border Protection (CBP) import data for the period of review and will release that CBP data under an Administrative Protective Order (APO) to parties with an APO within five days of the initiation notice. Commerce plans to decide respondent selection within 35 days of the publication of the initiation Federal Register notice.
Particular Market Situation Filing Window
If you want Commerce to consider a particular market situation (PMS) under section 773(e) that could change constructed value calculations, you must submit the PMS allegation and supporting factual information no later than 20 days after submission of initial Section D responses. If Commerce finds a PMS exists, it will modify its dumping calculations accordingly.
Treatment of Non‑Market‑Economy (NME) Entities
Commerce will not treat the non‑market economy (NME) entity as automatically subject to an AD administrative review unless a review of the NME entity is specifically requested or self‑initiated. If an individual exporter does not qualify for a separate rate, Commerce will decide that the exporter is part of the NME entity and, because no review of the NME entity was conducted, the NME entity rate will not change as a result of that review; Commerce also will instruct CBP to liquidate entries for exporters not named in the initiation notice.
Annual Inquiry Service List Update Deadline
Commerce will update annual inquiry service lists for the listed proceedings and you have 30 days after the date of this notice to submit a new or amended entry of appearance to be included; Commerce will finalize the lists five business days after that 30‑day window. Petitioners and foreign governments that have submitted an entry once will be automatically added to the list in following years.
