Shippers Can File Class Complaints

Starting January 2, 2025, the Federal Maritime Commission says private parties, including shippers and other third parties, are not barred from filing class action complaints with the Commission. The policy statement gives guidance to those groups on bringing class complaints at the Commission.

FMC May Use Federal Rule 23

The Commission said it may apply Rule 23 of the Federal Rules of Civil Procedure to evaluate class action complaints under 46 CFR 502.12 when those procedures are consistent with sound administrative practice. That means the familiar federal class-action procedures can be used in Commission proceedings where appropriate.
