Sudan TPS Extended 18 Months
DHS is extending Sudan's Temporary Protected Status (TPS) for 18 months from April 20, 2025 through October 19, 2026. If you are a national of Sudan (or stateless who last habitually resided in Sudan) and you continue to meet TPS requirements, you may remain in the U.S. and be authorized to work during that period. The notice also states there are approximately 1,900 current Sudanese TPS beneficiaries eligible to re-register.
Certain EADs Auto-Extended to April 19, 2026
If you have a Sudan TPS-based Employment Authorization Document (EAD) with category A-12 or C-19 and a 'Card Expires' date of April 19, 2025; June 30, 2024; Dec. 31, 2022; Oct. 4, 2021; Jan. 4, 2021; Jan. 2, 2020; April 2, 2019; Nov. 2, 2018; or Nov. 2, 2017, this Federal Register notice automatically extends your EAD through April 19, 2026 without further action. You may present the extended EAD to employers as proof of work authorization through that date.
60-Day Re-registration Requirement
Existing Sudan TPS beneficiaries who want to keep TPS through October 19, 2026 must re-register during a 60-day window from January 17, 2025 through March 18, 2025. If you do not re-register properly during that period, USCIS may withdraw your TPS and your employment authorization could lapse.
Up-to-540-Day EAD Extension If You Timely File
If you file a Form I-765 EAD renewal during the re-registration period (January 17, 2025 through March 18, 2025) and your renewal is under category A-12 or C-19, you may be eligible for an automatic extension of your current EAD of up to 540 days from the 'Card Expires' date on the EAD. That automatic extension cannot run past October 19, 2026.
Employers Must Accept Extended EADs for I-9
Employers must accept automatically extended Sudan TPS EADs (A-12 or C-19 with the qualifying 'Card Expires' dates) as valid List A documents for Form I-9 and may not require proof of Sudanese citizenship or TPS registration. Employers should update Form I-9 expiration fields as instructed and reverify by the end of the automatic extension.
Pending TPS/I-765 Filings Preserved
If you had a Sudan TPS Form I-821 or TPS-related Form I-765 pending as of January 17, 2025, you do not need to file again. If USCIS approves your pending I-821, you will be granted TPS through October 19, 2026, and if USCIS approves your pending I-765, USCIS will issue an EAD valid through the same date.
Biometric Fee Required; Fee Waiver Option
To re-register for Sudan TPS you must file Form I-821 and pay the biometric services fee; the Form I-821 application fee itself is not required for re-registration. If you cannot pay the biometric services fee (or the Form I-765 fee for an EAD), you may request a fee waiver by filing Form I-912 or following the fee waiver instructions.
