Half‑support rule for stepchild dependency

Under Section 202(d)(4) of the Social Security Act (as applied by the Railroad Retirement Act), a stepchild is deemed dependent only if the stepchild receives at least one-half of his or her support from the stepparent. That one-half support condition affects entitlement to increasing an employee's or spouse's annuity based on a dependent child.

Form G-139 required to get child's annuity

If you apply for a child's annuity through the Railroad Retirement Board, you must complete Form G-139 (Statement Regarding Contributions and Support of Children) to have your dependency judged. The RRB says one response is required per applicant and estimates each response takes 60 minutes; they expect about 400 responses per year (totaling 400 burden hours).
