The Secretary of HHS is directed to use authorities including Medicare or Medicaid conditions of participation or conditions for coverage, clinical-abuse assessments for State Medicaid programs, and mandatory drug use reviews to end chemical and surgical gender-transition treatments for minors under 19.
TRICARE Coverage Exclusion for Minors
The Secretary of Defense shall commence rulemaking or sub-regulatory action to exclude chemical and surgical gender-transition treatments for children under 19 from TRICARE coverage and amend the TRICARE provider handbook; TRICARE currently provides health insurance to nearly 2 million individuals under age 18.
Federal Employee Plans: Coverage Exclusion, 2026
The Office of Personnel Management is directed to include provisions in the Federal Employee Health Benefits (FEHB) and Postal Service Health Benefits (PSHB) 2026 Plan Year call letter requiring eligible carriers to exclude pediatric transgender surgeries and hormone treatments, and to negotiate corresponding reductions in FEHB and PSHB premiums.
DOJ Push for Private Lawsuits for Injured Children
The Attorney General, in consultation with Congress, is directed to work to draft, propose, and promote legislation to create a private right of action for children and parents whose children's healthy body parts have been damaged by medical professionals practicing chemical and surgical gender-transition treatments, including a lengthy statute of limitations.
DOJ Consumer Fraud and Safety Investigations
The Attorney General is directed to prioritize investigations and take action to end deception of consumers, fraud, and violations of the Food, Drug, and Cosmetic Act by entities that may be misleading the public about long-term side effects of chemical and surgical gender-transition treatments for minors.
