Silica Safety Rules for Miners Hit Court-Induced Pause

Published Date: 4/6/2026

Rule

Summary

Miners working with metal and nonmetal materials won’t see new silica dust rules kick in on April 8, 2026, because a court has paused the changes. This delay means current safety rules stay in place while the court reviews the case, so miners’ health protections continue without interruption. MSHA will announce when the new rules will actually start, keeping everyone in the loop and safe.

Silica Rule Delay Keeps Current Protections

If you work with metal or nonmetal materials, the new silica dust conforming amendments that were scheduled to take effect on April 8, 2026, are delayed indefinitely as of April 6, 2026, because of a court-ordered stay. The existing protections in 30 CFR 56.5001, 56.5005, 57.5001, and 57.5005 remain in effect until the court lift the stay.

Mine Operators Continue Current Compliance

If you operate a metal or nonmetal mine, MSHA is delaying indefinitely the conforming amendments to 30 CFR parts 56 and 57 that were to take effect April 8, 2026. You must continue to follow the existing standards in 30 CFR 56.5001, 56.5005, 57.5001, and 57.5005 until the court-ordered stay is terminated.
