Updated NFPA 59 Becomes Mandatory

Starting January 1, 2027, pipeline companies must follow the 2024 edition of NFPA 59, Utility LP-Gas Plant Code (the 2024 edition is effective September 14, 2023) as incorporated by reference into 49 CFR part 192, Sec. 192.11. PHMSA says the update will maintain or improve public safety and may increase national pipeline transportation capacity and operators' ability to provide abundant, reliable, affordable natural gas.

Early Compliance Allowed Before Effective Date

PHMSA authorizes compliance with the incorporated NFPA 59 updates after June 23, 2026, even though the direct final rule's formal effective date is January 1, 2027. If adverse comments are received by June 23, 2026, PHMSA will publish notice withdrawing the rule before January 1, 2027.

PHMSA Expects Little to No Cost Increase

PHMSA estimates the regulatory amendments will result in no significant costs and that total costs to the regulated community will be less than zero, because most operators already voluntarily apply such standards and any remaining compliance costs are expected to be negligible. PHMSA also states the rule could produce minimal cost savings by reducing regulatory burdens and uncertainty.

Updated Standard Made Available Free Online

PHMSA states the NFPA 59 material incorporated by reference is available free of charge from the NFPA website (https://www.nfpa.org/Codes-and-Standards/All-Codes-and-Standards/List-of-Codes-and-Standards) and can also be obtained via the publisher contact information listed in Sec. 192.7. This availability is provided under section 24 of the Pipeline Safety, Regulatory Certainty, and Job Creation Act of 2011.
