Federal OSHA Covers Private Worksites On Federal Land

Starting April 27, 2026, federal OSHA (not the Maryland State Plan) will enforce occupational safety and health rules for private-sector work on land that the United States or any unit of the United States leases or otherwise holds in Maryland. This includes sites where federal employees are regularly present for official duties, federal government-owned contractor-operated sites, and federal property under construction.

Federal Enforcement of Anti-Retaliation for Private Sector

Federal OSHA retains enforcement of the anti-retaliation provision of the OSH Act (Section 11(c), 29 U.S.C. 660(c)) with respect to the private sector in Maryland. The Maryland State Plan also concurrently investigates private-sector and state and local government workplace retaliation cases under an analogous state provision.
