Federal OSHA regains enforcement on federal sites

Starting April 24, 2026, federal OSHA will take back enforcement responsibility for private‑sector work on federal government owned or leased property, at federal government‑owned contractor‑operated sites, on construction on federal property, and for marine construction done by private employers. Coverage for these specific private‑sector situations has been transferred from the Puerto Rico State Plan to federal OSHA under the new Operational Status Agreement signed September 25, 2025.

OSA adds explicit federal coverage list

The 2025 Operational Status Agreement explicitly states federal OSHA will cover federal government employers (including the U.S. Postal Service) and contractor‑operated USPS mail operations; private‑sector employers within secured borders of U.S. military installations where access is controlled; and all working conditions of aircraft cabin crewmembers onboard aircraft in operation. These clarifications were added to make who has enforcement authority clearer.

Federal handling of monitoring and whistleblowers

Federal OSHA will continue to carry out inspections and investigations needed for monitoring under Section 18(f) of the OSH Act and will enforce complaints filed under the OSH Act whistleblower provision, Section 11(c). These responsibilities are stated in the 2025 OSA and will be exercised by federal OSHA in Puerto Rico as described in the notice.

Federal may inspect entire projects for practicality

The 2025 OSA adds a provision allowing federal OSHA to inspect and take enforcement action at an entire project or facility where both federal and State Plan authorities have jurisdiction, and federal enforcement may be exercised immediately upon agreement between the agencies. This is intended for administrative practicability.
