AXN/FEMC Imports Found Subject to Duties

The Department of Commerce determined that certain axle beams, slider boxes, and landing gear sets imported by AXN (formerly AXN Heavy Duty LLC, now FEMC LLC) from the People’s Republic of China are covered by existing antidumping (AD) and countervailing duty (CVD) orders. This final determination is applicable April 27, 2026, and means those specific imported parts are officially treated as subject merchandise under the Orders.

Suspension of Liquidation and Cash Deposits

Commerce directed U.S. Customs and Border Protection (CBP) to continue suspension of liquidation and apply AD and CVD cash deposit rates for previously suspended entries and to require cash deposits for unliquidated entries of the product entered or withdrawn for consumption on or after April 3, 2025. Commerce also directed suspension and cash deposits for unliquidated entries entered for consumption before April 3, 2025 but after November 4, 2021.

Importer Certification and Documentation Rules

Commerce imposed an importer-specific certification requirement (see Appendix II) for AXN's entries of Chinese-origin axles, axle assemblies, slider boxes, and landing gear sets that could be used to produce chassis. Entries made prior to May 13, 2026 must be certified as soon as applicable but no later than 45 days after publication of this determination, and entries on or after May 13, 2026 must be certified at the time of entry summary filing. Importers must upload the certification, commercial invoice, and bill of lading into CBP's ACE document imaging system and identify certified entries using importers' additional declaration (record 54) AD/CVD Certification Designation (type code 06); records must be retained for the later of five years after the latest entry or three years after litigation.
