Notice

Summary

The FMCSA is giving 14 drivers with epilepsy or seizure disorders a green light to drive commercial trucks across state lines while on medication. This move shows trust in medical progress and opens doors for qualified drivers who once faced strict limits.

Analyzed Economic Effects

3 provisions identified: 2 benefits, 1 costs, 0 mixed.

14 Drivers Cleared to Drive Interstate

FMCSA granted exemptions to 14 named commercial drivers so they may operate commercial motor vehicles in interstate commerce while taking anti-seizure medication. The exemptions are effective April 6, 2026 and expire April 6, 2028, and apply only to the 14 individuals listed in the notice.

Ongoing Medical and Reporting Requirements

Each exempt driver must remain seizure-free, maintain a stable treatment, report any seizure to FMCSA within 24 hours, submit annual treating-physician reports and an annual medical exam by a certified medical examiner, and provide annual certified driving records. Drivers must also report crashes and disqualifying citations or convictions within 7 days and carry a copy of the exemption while driving.

Federal Exemption Preempts Conflicting State Laws

While an exemption is in effect, no State may enforce a law or regulation that conflicts with the exemption for the person operating under it. This preemption applies for the two-year exemption period from April 6, 2026 through April 6, 2028 for the listed drivers.
