Must Notify EPA Before Making New Chemicals

If you plan to manufacture or import a chemical that is not on EPA's TSCA Inventory, you must provide EPA a PMN, MCAN, or SNUN under TSCA section 5 before starting the activity. The notice applies to activities subject to TSCA section 5 and EPA will review the submission and make a risk determination.

Test Marketing Exemption Option (TME)

Under TSCA section 5(h)(1), EPA can allow persons to manufacture or process a new chemical for test marketing (a TME) under restrictions if the applicant shows the activity will not present an unreasonable risk. This provides an option to test-market a new chemical under EPA-imposed limits.

Public Comment Opportunity by July 10, 2026

The public may submit comments on the listed new chemical submissions to docket EPA-HQ-OPPT-2026-1387 online at regulations.gov; comments must be received on or before July 10, 2026. The notice also instructs not to submit Confidential Business Information (CBI) via regulations.gov.

EPA Posts Status and Non-CBI Details Online

EPA provides periodic status reports and non-CBI information about TSCA section 5 submissions on its website and in ChemView (https://chemview.epa.gov/chemview). The tables in this notice list submissions determined complete for the period 2026-02-01 through 2026-02-28.
