No more ‘in care of’ mailing field
If you are a subject of immigration proceedings, EOIR proposes removing the Form EOIR-33 fields that let you list an "in care of" (third‑party) recipient for mail. EOIR says the fields are being removed to reduce risks of mail interception and identity fraud and to prevent concealment of a subject's true address.
You must report address changes quickly
Subjects of immigration proceedings must provide their current address and contact information using Form EOIR-33 and EOIR and the opposing party will send service copies to the address on the latest submitted form. EOIR cites 8 U.S.C. 1229(a)(1)(F) and 8 CFR 1003.15(d)(2) and reiterates that address updates must be provided promptly (the regulation requires updates within five days of any change).
Time and money to complete form
EOIR estimates an average of 719,634 respondents will complete the Form EOIR-33 each year, taking 5 minutes each (totaling 59,730 hours annually) and occurring once per year. EOIR reports a minimum public cost of $0 (electronic filing, no postage) and a maximum estimated public cost of $62,145,241 (including printing, postage, and optional attorney assistance), with $0.88 printing/postage per mailed form and a national average lawyer hourly wage of $84.84 noted for maximum labor cost calculations.
