Must Use ACE/CAPE or Broker

If you are an importer or a business seeking refunds of IEEPA duties, you (the importer of record) or your licensed customs broker must submit refund requests through the ACE Portal using the CAPE tool. CBP says only ACE account holders (or their designated licensed brokers as the "notify party") can file CAPE Declarations; most small businesses that lack ACE accounts are expected to keep using brokers, and CBP may consider an alternative process if ACE/CAPE is overly burdensome.

Consolidated Refund Payments via CAPE

The CAPE tool lets CBP process multiple entry summaries for the same importer in a single CAPE Declaration so thousands of refund transactions can be consolidated into a single payment that is directly deposited to the importer's account. Each CAPE Declaration accepts a CSV file of entry summary numbers with a limit of 9,999 entries per declaration.

Refunds Issued Electronically (ACH) Only

CBP issues refunds electronically via Automated Clearinghouse (ACH) and is holding refunds for filers who do not have an ACH account on file in ACE. If an importer seeks payment by U.S. Treasury check, the importer must notify CBP's Revenue Division in writing at the email address specified in the notice to request a waiver under 31 CFR part 208.

Paperwork and CSV Burden Estimates

CBP estimates the CAPE CSV information collection will involve about 330,000 respondents submitting 495,000 annual responses at about 1 hour per response (495,000 total burden hours), plus a CSV replacement collection with 33,000 respondents and 16,500 total burden hours. The CAPE CSV submissions will be screened and may be rejected, requiring resubmission.
