IOR Numbers Can Be Immediately Voided
Beginning September 18, 2026, CBP will void Importer of Record (IOR) numbers if the information on CBP Form 5106 is incomplete or inaccurate. A voided IOR number is invalid for any purpose, including entering imported merchandise into the United States.
Customs Brokers Face Due Diligence And Penalties
Customs brokers submitting CBP Form 5106 for clients must have a valid power of attorney executed directly with the IOR and must exercise due diligence to verify information. Brokers or IORs who submit false or unverified information may face fines, imprisonment under 18 U.S.C. 1001, liability under the False Claims Act (31 U.S.C. 3729 et seq.), and broker penalties under 19 U.S.C. 1641.
Specific Contact and ID Data Must Belong To IOR
When submitting CBP Form 5106, the importer name, IRS EIN or SSN, mailing address, physical location address, phone number, and email address must be accurate and must belong directly to the IOR. The physical address cannot be a registered agent, customs broker, freight forwarder, P.O. box, or business service center (the principal's home address may be used).
Process To Request Reestablishment After Voiding
If CBP voids an IOR number, CBP will send a written notice to the IOR's most recently submitted email explaining why and how to request reestablishment, including what identity information to submit to corroborate the IOR. The IOR or a customs broker with a valid power of attorney may request reestablishment by emailing CBP at [email protected].
