AmeriCorps Ends Disparate‑Impact Liability

The proposal would remove 45 CFR 1203.4(b)(2), delete two instances of “or effect” in 45 CFR 1203.4(d), and state that AmeriCorps will not enforce Title VI against unintentional disparate effects.

AmeriCorps proposes to remove the full text of 45 CFR 1203.4(b)(4) (the rule that required or authorized ‘‘affirmative action’’ to overcome prior or systemic effects) and to replace the phrase "take affirmative action to insure" with "ensure" in 45 CFR 1203.4(c)(1). This signals that recipients should not be required to adopt race‑based preferences under AmeriCorps’ Title VI rules.
Title VI Won't Reach Non‑Employment Grants' Hiring
