Medicare Seeks Public Yawns on Paperwork Burden Estimates

Summary
The Centers for Medicare & Medicaid Services (CMS) is announcing an opportunity for the public to comment on CMS' intention to collect information from the public. Under the Paperwork Reduction Act of 1995 (PRA), federal agencies are required to publish notice in the Federal Register concerning each proposed collection of information, including each proposed extension or reinstatement of an existing collection of information, and to allow a second opportunity for public comment on the notice. Interested persons are invited to send comments regarding the burden estimate or any other aspect of this collection of information, including the necessity and utility of the proposed information collection for the proper performance of the agency's functions, the accuracy of the estimated burden, ways to enhance the quality, utility, and clarity of the information to be collected, and the use of automated collection techniques or other forms of information technology to minimize the information collection burden.

Individual coverage HRAs can pay Medicare premiums
Under the 2019 final regulations (effective for plan years beginning on or after January 1, 2020), employers may offer individual coverage HRAs that employees can use to pay medical care expenses, including premiums for individual health insurance and Medicare (Parts A and B, or Part C), subject to applicable requirements.
CMS extends HRA data collection
CMS is seeking an extension of an existing information collection (Form CMS-10704, OMB Control Number 0938-1361) about Health Reimbursement Arrangements. The collection is annual, lists 6,354 respondents, 1,347,048 total annual responses, and 3,136 total annual hours, and is open for comments to OMB through August 31, 2026.
Notice rule for excepted benefit HRAs
Non-federal governmental employers offering excepted benefit HRAs must give participants a notice that describes eligibility conditions, any annual or lifetime caps or limits, and a summary of benefits no later than 90 days after an employee becomes a participant and annually thereafter.
