Report for Work Outside U.S./Canada
Offerors and contractors must submit a Report of Contract Performance Outside the United States for subcontracts to be performed outside the U.S. The rule sets a reporting threshold of $750,000 for contracts that exceed $15,000,000 and allows use of DD Form 2139 or an equivalent computer-generated report.
UK Levies Information for Certain Contracts
DFARS 252.225-7032 and 252.225-7033 require United Kingdom offerors and prime contractors, and offerors and prime contractors with subcontracts exceeding $1,000,000 with U.K. firms, to provide information needed for DoD to obtain a waiver of United Kingdom levies.
Paperwork Extension for DFARS Part 225
The Department of Defense is extending an approved information collection under DFARS Part 225 that applies to businesses and not-for-profits. The collection covers 38,546 respondents, about 377,597 annual responses, an average burden of 0.28 hours per response, and 104,490 total annual burden hours.
Buy American and FTA Certificates Required
Offerors must identify supplies that are not domestic end products and separately list qualifying-country and other foreign end products under Buy American and Free Trade Agreement certificates. The Buy American statute does not apply to acquisitions of commercial information technology.
Identify U.S. Expenditures on Payment Requests
Contractors incorporated or located in the United States must identify on each request for payment the part of the payment representing estimated expenditures in the United States for supplies used or services performed outside the United States.
Specialty Metals Compliance Certification
Offerors providing commercial derivative military articles who choose an alternative compliance approach must certify certain actions regarding specialty metals under DFARS 252.225-7010.
Duty-Free Entry Shipping Documentation
Contractors or authorized agents must provide information on shipping documents and customs forms for items eligible for duty-free entry under DFARS 252.225-7013.
Photovoltaic Devices Country-Origin Certificate
Offerors must certify that no photovoltaic devices with an estimated value exceeding the micro-purchase threshold will be used in contract performance, or else specify the country of origin, under DFARS 252.225-7018.
Trade Agreements End Product Listing
Solicitations subject to the World Trade Organization Government Procurement Agreement require a Trade Agreements Certificate that lists nondesignated-country end products under DFARS 252.225-7020.
Forgings Record Retention Requirement
Under DFARS 252.225-7025, contractors must retain records showing compliance with restrictions on acquisition of forgings until 3 years after final payment and make those records available to the contracting officer on request; contractors may request a waiver under DFARS 225.7102-3.
Exports Representation for Solicitation Responses
DFARS 252.225-7046 requires offerors to represent whether exports or transfers of qualifying defense articles were made in preparing the response to a solicitation, and if so, to represent that those exports or transfers complied with the provision's requirements.
