Korea Pipe Dumping Review: Commerce Plays Trade Cop Again

Cash Deposit Rate Rules and Thresholds
Commerce will instruct U.S. Customs and Border Protection to collect cash deposits of estimated countervailing duties on shipments entered on or after the date of the final results. If a company-specific rate is less than 0.50 percent it will be treated as de minimis and the cash deposit rate will be zero; the all-others rate remains 9.29 percent.
Preliminary Countervailing Duty Rates
Commerce preliminarily found countervailable subsidies for large diameter welded pipe from Korea for the period January 1, 2024 through December 31, 2024. It preliminarily assigned a 1.00% net subsidy rate to Hyundai Steel Pipe Co., Ltd., a 0.27% rate (de minimis) to SeAH Steel Corporation, and a 1.00% specific rate to non-selected companies receiving review.
Rescission for Companies with No Reviewable Entries
Commerce is rescinding this administrative review in part for companies that either withdrew review requests or had no suspended entries during January 1, 2024 through December 31, 2024. For those rescinded companies, Commerce will instruct CBP to assess duties at the cash deposit rate that was required at the time of entry or withdrawal from warehouse for consumption.
Timing of Assessment and Liquidation Instructions
Commerce intends to issue assessment instructions to CBP no earlier than 35 days after publication of the final results of this review, and rescission instructions no earlier than 35 days after this notice. If a timely summons is filed at the U.S. Court of International Trade, Commerce will direct CBP not to liquidate relevant entries until the statutory injunction filing period has expired (within 90 days of publication).
