Contingent Permission for Overnight Trading

If the Equity Data Plans fail to begin extended-hours SIP operations by December 6, 2026, the SEC will allow 24X to run an overnight trading session from 9:00 p.m. to 4:00 a.m. Eastern (Sunday–Thursday nights) starting January 24, 2027. That permission would last only until the Equity Data Plans implement the Extended Hours Amendments or until July 2, 2027, whichever comes first.

Free Real-Time 24X Overnight Data Feed

As a condition of the temporary relief, 24X must make a proprietary real-time data feed (with quotation and last-sale information) available to the public free of charge during the exempted overnight period. The Exchange also must make certain disclosures and provide quarterly data to the Commission as conditions of this limited relief.

Path for Other Exchanges to Offer Overnight Trading

The Order states that if 24X (or a similarly situated registrant) requests and is granted comparable temporary exemptive relief, those exchanges could also commence overnight trading under the same contingency and timing conditions. This creates a path for multiple national exchanges to offer overnight hours if the Equity Data Plans miss the December 6, 2026 implementation date.
