Easement Risk and Eminent Domain

If you are a landowner in the project area and receive notice, the pipeline company may seek to negotiate an easement with you, but you are not required to agree. If FERC approves the project, the Natural Gas Act conveys eminent domain authority for facilities constructed under section 7, and if an agreement isn’t reached the company could initiate condemnation proceedings in court with compensation determined by a judge under state law.

Construction and Permanent Land Disturbance

The project would disturb about 69.2 acres for the Terminal Site Expansion during construction and operation; the Marine Facilities Expansion would disturb about 20.4 acres during construction and 3.4 acres during operation. Construction of the Silsbee Compressor Station and pipeline laterals would disturb about 73.7 acres and 4.6 acres respectively, with about 52.8 acres and 2.0 acres to be maintained for permanent operation after construction.
