The Executive Office for Immigration Review (EOIR), Department of Justice (DOJ), will be submitting the following information collection request to the Office of Management and Budget (OMB) for review and approval in accordance with the Paperwork Reduction Act of 1995.

High Filing Fees for Cancellation Forms

If you file Form EOIR-42A you must pay a $710 filing fee. If you file Form EOIR-42B you must pay a $1,649 filing fee.

Filing either form takes an average of 5 hours and 50 minutes (5.83 hours) per response. Hiring a practitioner is estimated to cost $494.62 per filing; the combined total annual burden is 88,873 hours, and estimated total annual public costs are $1,762,956 for EOIR-42A and $29,509,956 for EOIR-42B. Forms may be submitted electronically to avoid printing and postage costs.

EOIR-42A/B Form Content Changes

If you are in removal proceedings and file EOIR-42A or EOIR-42B, the forms were revised to remove unnecessary questions, generalize Question 21 about visa types, remove irrelevant fields in Part 7, and require your signature in Part 9 at the time you file. The Advice to Applicants, Instructions, and form text were also updated to mirror the Immigration and Nationality Act.
