Filings Must Include Proper Fee or Waiver

Starting October 1, 2026, EOIR will require that any relevant filing include the updated FY2027 filing fee or a request for an applicable fee waiver; EOIR will continue to reject filings that are not accompanied by a proper filing fee or fee waiver request.

EOIR Filing Fees Increased for FY2027

If you file appeals, motions, or certain applications with the Executive Office for Immigration Review (EOIR) on or after October 1, 2026, the OBBBA portion of those fees was increased using a 3.4% CPI-U adjustment and rounded (generally to the nearest $10). Examples of the updated total fees include: Notice of Appeal (Forms EOIR-26 and EOIR-29) total $1,060; Form EOIR-45 total $2,070; motions to reopen or reconsider (immigration judge) total $1,095; Form EOIR-40 and EOIR-42A total $730; and Form EOIR-42B total $1,690.
