The Federal Communications Commission (Commission or FCC) is correcting a final rule that appeared in the Federal Register on July 31, 2026. The text of the Report and Order, Order of Proposed Modification, and Order on Reconsideration inadvertently contained minor editorial errors and incorrectly restated the number of years provided in the definitions of the first and second performance benchmarks, which are corrected as detailed below. We make this correction to improve the clarity and internal consistency of the document.

Failing second buildout cancels license area
If a licensee fails to provide reliable signal coverage and offer service to at least 80% of the population in a license area no later than six years after the relevant Transition Deadline, that authorization for the license area will terminate automatically without Commission action and the licensee will be ineligible to regain it if the Commission later makes it available.
First buildout deadline: 45% in 2 years
If you hold an Upper C‑Band license, you must provide reliable signal coverage and offer service to at least 45% of the population in the license area no later than two years after the relevant Transition Deadline. If you fail that first performance benchmark, the rule accelerates your second performance benchmark by one year.
