Commerce Slaps Preliminary Dumping Tag on Brazilian Brass Rods

Summary
The U.S. Department of Commerce (Commerce) preliminarily determines that Termomecanica Sao Paulo S.A. (Termomecanica), a producer/exporter subject to this administrative review, made sales of brass rod at less than normal value (NV) during the period of review (POR), December 1, 2023, through May 31, 2025. Interested parties are invited to comment on these preliminary results.

22.07% Preliminary Dumping Margin
Commerce preliminarily found that Termomecanica Sao Paulo S.A. sold brass rod at a 22.07% dumping margin for the period December 1, 2023 through May 31, 2025. If this margin is finalized, importers of Termomecanica brass rod could face antidumping duties based on that percentage.
Importer-Specific Assessment Method
If Termomecanica's final dumping margin is not zero or de minimis (less than 0.50%), Commerce will calculate importer-specific assessment rates using the ratio of total dumping to entered value; where entered values are missing, Commerce will calculate a per-unit rate. Commerce intends to issue assessment instructions to U.S. Customs and Border Protection no earlier than 35 days after publication of the final results, and the final results are to be issued no later than 120 days after publication.
Cash Deposit Rates After Final Results
New cash deposit requirements will apply to shipments entered or withdrawn for consumption on or after the publication date of the final results of this review. The cash deposit rate for companies covered in the final results will be the rate established there unless the rate is less than 0.50%, in which case the cash deposit rate will be zero; the all-others rate from the original investigation is 22.78% and will apply to other manufacturers/exporters not covered.
Reimbursement Certificate Requirement
Importers must file a certificate regarding reimbursement of antidumping duties prior to liquidation of relevant entries during the period of review. If an importer fails to file this certificate, Commerce may presume reimbursement occurred and assess double antidumping duties.
Automatic Assessment for Unknown Destinations
For entries of Termomecanica-produced merchandise where Termomecanica did not know the goods were destined for the United States, Commerce intends to instruct CBP to liquidate those entries at the all-others rate from the less-than-fair-value investigation if no rate exists for intermediate companies. The all-others rate from the LTFV investigation is 22.78%.
