The Executive Office for Immigration Review (EOIR) at the Department of Justice (DOJ) will be submitting the following information collection request (ICR) to the Office of Management and Budget (OMB) for review and approval in accordance with the Paperwork Reduction Act of 1995.

Form EOIR-59 Authorizes Record Releases

If you are in or have been in proceedings before EOIR, you can use Form EOIR-59 to authorize EOIR to disclose your case records or audio recordings to an attorney, accredited representative, qualified organization, or another third party. The form is voluntary and EOIR estimates 87,080 respondents will complete it annually.

Parent/Guardian Name Field Added

EOIR added a new field in Part C of Form EOIR-59 to collect the printed name of a parent or guardian to help verify identity when a parent or guardian signs. This change is intended to help EOIR personnel confirm parent/guardian identity when signatures are hard to read.

Time and Money Burden For Responding

EOIR estimates each Form EOIR-59 response takes about 10 minutes (0.17 hours) and that 87,080 responses will be submitted annually, for a total annual time burden of 14,804 hours. EOIR estimates total possible annual public costs range from $0 up to $1,264,298.88 (including up to 8,537 mailed submissions with $0.10 per page printing, $0.78 postage per mailed response, and a potential $14.42 labor cost per response if a practitioner charging $84.84/hour assists).
