Race/Ethnicity-Based Target Markets Removed
The CDFI Fund will stop allowing 'Other Targeted Population' Target Market types based on race or ethnicity, specifically: African American, Hispanic, Other Pacific Islander, Filipino, and Vietnamese. Certified CDFIs that currently rely on one of these now-prohibited Target Market types must seek approval to serve one or more remaining eligible Target Market types and the Fund is planning a one-year transition period to do so.
New and Potential Additional ACR Reporting Requirements
The CDFI Fund is adding questions to the ACR about changes in administrative proceedings history and compliance in other federal award programs. The Fund is also considering requiring audited financial statements for items referencing the most recently completed fiscal year balance sheet, and is asking for estimates of burden hours if such a requirement were adopted.
Reporting Thresholds and Loan-Level Reporting Considered
The CDFI Fund is considering raising the minimum threshold of closed financial products an institution must have to maintain certification, and is considering eliminating the Consumer Loan Report (CLR) in favor of individual loan-level reporting via the abbreviated or full TLR for regulated entities. The Fund asks whether these changes would impose burdens and what reasonable thresholds should be.
Estimated Respondent Counts, Hours, and Comment Deadline
The notice lists estimated annual respondents and burden hours: 1,277 ACR respondents at 20 hours each (25,540 total hours) and 849 abbreviated TLR respondents at 20 hours each (16,980 total hours). The CDFI Fund anticipates an overall net reduction in burden and requests public comments by November 30, 2026.
Abbreviated TLR Drops Owner Demographics and Climate Fields
The abbreviated Transaction Level Report (TLR) will no longer collect data fields about the minority status or sex of the business owner, nor will it include climate-centered financing fields. These reporting fields will be removed from the abbreviated TLR form.
Board Demographics and Accountability Questions Removed
The ACR will eliminate most 'BOARD AND EXECUTIVE STAFF DEMOGRAPHIC INFORMATION' questions except two questions on total governing leadership size and total executive staff size. The 'Accountability' section and the 'Native American TM Accountability Attestation' question will be removed, and Target Market accountability will instead be measured through Target Market activity rather than board representation.
