Existing Licensee Deemed to Decline Relicensing

Shoshone Irrigation District missed the notice-of-intent (NOI) deadline that was due by the close of business on September 30, 2026, and is therefore treated as having indicated it does not intend to apply for a new license for the Garland Canal Project (Project No. 3031). Under 18 CFR 16.24, the existing licensee may not file an application to relicense the project, either alone or together with any entity that is not currently a licensee.

120-Day Window for New Applicants to File

Because the existing licensee failed to file its NOI, other parties now have 120 days from the date of this notice to file a notice of intent (NOI), a pre-application document (PAD), and any request to use an alternative licensing process for Garland Canal Project No. 3031. Interested applicants must file those documents within that 120-day period to proceed.

Firm Deadline to File License Applications

Federal Energy Regulatory Commission rules require new license applications to be filed at least 24 months before the current license expires. For the Garland Canal Project (license expiration September 30, 2031), any application for a new license must be filed by September 30, 2029.

Option to Request Alternative Licensing Procedures

When filing an NOI, a potential license applicant may request to use alternative licensing procedures instead of the default integrated licensing process by invoking 18 CFR 5.3(b). Parties filing NOIs and PADs within the 120-day window may include such requests.

Accelerated ILP Process Plan Timeline

If an interested applicant files an NOI and PAD and elects or is required to use the Commission's Integrated Licensing Process (ILP), the Commission will issue a process plan within 180 days of this notice to accelerate ILP steps so a license application can be filed by the September 30, 2029 deadline.
