Notice
Summary
The U.S. Department of Commerce found that Oman Fasteners didn’t sell steel nails at unfairly low prices from July 2024 to June 2025. They also plan to stop reviewing 15 other companies in this case. This means some companies might avoid extra duties, and everyone has a chance to share their thoughts before the final decision.
Analyzed Economic Effects
5 provisions identified: 2 benefits, 3 costs, 0 mixed.
Gulf Nails preliminarily assigned 9.10% rate
Commerce preliminarily assigned Gulf Nails LLC a weighted-average dumping margin of 9.10 percent for the period July 1, 2024 through June 30, 2025. The notice explains Commerce applied the 9.10 percent all-others rate from the less-than-fair-value investigation as the rate for the non-individually examined respondent.
All-others cash deposit rate remains 9.10%
The notice states that, for exporters or manufacturers not covered by this review or the LTFV investigation, the cash deposit rate for subject merchandise will continue to be 9.10 percent (the all-others rate established in the LTFV investigation). These deposit requirements apply to shipments entered or withdrawn from warehouse for consumption on or after the publication date of the final results of this administrative review.
Oman Fasteners preliminarily found at 0% dumping
Commerce preliminarily found that Oman Fasteners LLC had a weighted-average dumping margin of 0.00 percent for the review period July 1, 2024 through June 30, 2025. The notice states that if Oman Fasteners' final weighted-average dumping margin is zero or de minimis (i.e., less than 0.50 percent), Commerce will instruct U.S. Customs and Border Protection (CBP) to liquidate the appropriate entries without regard to antidumping duties.
Automatic assessment for unknown-destination entries
Commerce states that for entries of subject merchandise produced by Oman Fasteners where the producer did not know the merchandise was destined for the United States, Commerce intends to instruct CBP to liquidate those entries at the all-others rate (9.10%) from the LTFV investigation if there is no rate for the intermediate company(ies) involved in the transaction.
Review to be rescinded for 15 companies
Commerce states it intends to rescind the administrative review, in part, for the 15 companies listed in Appendix II because CBP import data on the record show they did not have reviewable entries of subject merchandise during the period July 1, 2024 through June 30, 2025. The rescission is being made pursuant to 19 CFR 351.213(d)(3).
